This process applies to all members, including corporate and individual global mobility providers who are affiliated with the Association.

Disciplinary action may be initiated in cases of, but not limited to:

  • Breaches of EuRA's Code of Conduct
  • Unethical business practices, including fraud or misrepresentation
  • Non-compliance with legal or regulatory requirements
  • Discriminatory or harassing behaviour
  • Breaches of confidentiality or data protection laws
  • Any other action that damages the integrity or reputation of the Association or the global mobility industry
  • Any violation of the Code of Conduct, policies or documents in force within EuRA

Reporting Violations:

  • Complaints must be submitted in writing to the CEO
  • Complaints should include relevant evidence and details to support the claim
  • When necessary, the CEO will put together a relevant committee.  This may include EG members and/or a strategic consultant.  The CEO will not be part of the committee

Investigation Process:

  • The CEO, or the committee if relevant, will review the complaint and determine if it warrants an investigation
  • The accused member will be informed of the complaint and given an opportunity to respond
  • A formal investigation may include interviews, document reviews and discussion with involved parties
  • The investigation should be concluded within a reasonable timeframe, typically 30-60 days

Depending on the severity of the violation the following potentially cumulative actions may be taken:

  • Warning: A formal notice of the violation with corrective actions required
  • Probation: A specified period during which the member must demonstrate compliance
  • Expulsion: Permanent removal from the Association
  • Legal Action: In cases of severe misconduct or illegal activity, the matter may be referred to authorities 

Appeals Process:

  • Members have the right to appeal disciplinary actions in writing within 14 days of receiving the decision
  • Appeals must be submitted in writing with justification for reconsideration
  • When necessary, the CEO will together an appeal committee.  This may include EG members and/or a strategic consultant
  • The CEO, or committee if relevant, will reply in writing to the member.  The committee will judge the evidence and their findings will be binding from EuRA's perspective 

Confidentiality:

  • All disciplinary proceedings will be conducted with strict confidentiality while being handled by the CEO or committee

Monitoring:

  •    The Association will monitor compliance with disciplinary measures

Amendments and Updates

  • This policy is subject to periodic review and updates to ensure its effectiveness and alignment with industry standards
  • Members will be notified of any changes to the disciplinary process
